Legal Options After a Fatal Hit-and-Run in Schuyler, NE
When a person dies in a hit-and-run crash, eligible family members or the representative of the deceased person's estate may have legal options for seeking compensation. The available options depend on the circumstances, applicable Nebraska law, and whether relevant insurance coverage or other sources of compensation are available.
One of the first steps is to understand what evidence may support a potential claim. Police reports, witness statements, photographs, and surveillance footage may help establish how the crash occurred and identify the parties involved. Preserving relevant records can help clarify the circumstances and provide information that may be useful when evaluating legal options.
Insurance coverage is another factor that may influence a family's options. Depending on the circumstances and policy terms, uninsured motorist coverage may apply to certain hit-and-run claims. Other insurance policies may also provide potential avenues for compensation. Reviewing the applicable policies can help clarify coverage limits, exclusions, and requirements for submitting a claim.
In addition to reviewing insurance options, families may need to consider the financial losses associated with the death. Depending on the circumstances, a wrongful death claim may include funeral and burial expenses, medical costs incurred before death, lost financial support, and other damages recognized under Nebraska law. The types of damages available depend on the legal basis of the claim and the evidence supporting the losses.
Keeping financial and legal records organized can help support this process. Families may wish to retain funeral expenses, medical bills, insurance documents, income records, and information showing the financial contributions the deceased person provided. Maintaining copies of correspondence with insurers and other relevant paperwork can also help when reviewing a potential claim.
Because legal requirements can affect the options available, understanding applicable deadlines is also important. Nebraska law sets time limits and other requirements for certain wrongful death and insurance claims. The relevant deadlines and procedures depend on the circumstances, so families considering legal action may wish to seek guidance promptly.
