What Injuries Are Common in Pedestrian Accidents in Omaha, NE?
After a pedestrian crash in Omaha, common injuries include broken bones, head and brain injuries, spinal cord injuries, internal injuries, and deep cuts. Pedestrians have little protection, so even a low-speed crash can cause serious harm.
Even if you feel fine, pain, dizziness, or stiffness may appear hours or days after the crash. Seeing a doctor promptly can help identify hidden injuries and ensure you receive proper care.
To support your claim, keep the police report, photos of the crash site and your injuries, and witness contact information. Save your medical records and bills as well. These documents can help show what happened and how the crash affected you.
Because Nebraska is an at-fault state, your pedestrian injury claim generally goes through the insurance company of the driver found responsible. You must establish liability, and payment depends on the available coverage and facts of your case.
If the driver has little or no insurance, uninsured or underinsured motorist coverage may help. Nebraska generally requires this coverage on qualifying auto policies. Depending on your policy and insured status, you may be covered while walking, including through a household policy.
Under Nebraska law, you generally have four years to file a personal injury lawsuit after a pedestrian crash. If you miss the applicable deadline, you could lose your right to pursue a claim. Some exceptions may apply.
If the insurer questions whether your injuries are related to the crash, an
Omaha pedestrian accident lawyer can use your medical records to help establish the connection. Your attorney can also handle calls and paperwork with the insurer while you focus on your recovery.
