What Compensation Can I Recover After a Car Accident in Omaha, NE?
After a car accident in Omaha, you may be able to recover compensation for your medical bills, lost wages, vehicle damage, and pain and suffering. The amount you can receive depends on your injuries and how the crash has affected your daily life.
In most cases, compensation comes from the insurance company of the driver who caused the crash. Nebraska is an at-fault state, which means the person responsible for an accident is also responsible for paying for the harm it causes. You would usually file your claim with that driver's insurer.
To support your claim, keep copies of your medical bills, pay stubs, and repair estimates. Take photos of your injuries and your car as soon as you can. These records give the insurance company clear proof of what the crash has cost you and make it harder to downplay your losses.
If you're found partly at fault, Nebraska's comparative fault rule reduces your compensation by your share of the blame. For example, if you're 20% at fault, your recovery drops by 20%. However, if you're found 50% or more at fault, you can't recover anything.
If the other driver is uninsured or underinsured, your own policy may help. Nebraska requires auto insurance policies to include uninsured and underinsured motorist coverage. This coverage can help pay for losses the other driver's insurance can't cover.
Under Nebraska law, you generally have four years from the date of the accident to file a personal injury lawsuit. If you miss this deadline, the court will likely dismiss your case, and you may lose your right to seek compensation entirely.
When insurance companies dispute your claim or offer less than you need, an
Omaha car accident lawyer can help you understand your options. An attorney can also gather evidence, calculate your losses, and negotiate with insurers on your behalf.
