How Do Car Accident Claims Work in Omaha, NE?
A car accident claim in Omaha usually goes through the insurance company of the driver who caused the crash. Nebraska is an at-fault state, so the responsible driver’s insurance generally covers the losses. Most claims end in a settlement, but you may need to file a lawsuit if an agreement cannot be reached.
To get your claim started, notify your own insurance company and contact the other driver’s insurer. Provide the basic details of the crash, including when and where it happened. The insurance company will review the information and begin investigating the claim.
To support your claim, keep photos of the crash site and damaged vehicles, a copy of the police report, and the names of any witnesses. These details can help explain what happened if the drivers give different accounts of the crash.
Depending on your injuries, you may be able to recover compensation for medical bills, lost wages, vehicle damage, and pain and suffering. Your medical records and bills can help show how much your injuries have cost you and what your claim may be worth.
If the other driver doesn't have enough insurance, your own underinsured motorist coverage may help cover some of your losses. Nebraska generally requires uninsured and underinsured motorist coverage, although policy limits and certain exceptions may affect what your insurer pays.
Under Nebraska law, you generally have four years from the date of a car accident to file a personal injury lawsuit. If you miss this deadline, you could lose your right to sue. Some claims have shorter deadlines or special requirements.
If your injuries need ongoing treatment or keep you out of work, an
Omaha car accident lawyer can figure out what your losses are worth and which insurance policies apply. An attorney can also handle the insurer's questions and negotiate on your behalf.
