Train Crash Kills Two Near 12th St Near Plattsmouth, NE
Plattsmouth, NE (September 10, 2026) – Two people died after a small SUV and a train collided near 12th Street and Church Road, southwest of Plattsmouth, on Thursday, September 10. The wreck was reported shortly before 6:00 a.m.
Cass County Sheriff’s deputies arrived and found two people inside the SUV dead. Early information showed that the SUV, which had Texas license plates, was traveling west on Church Road before the crash.
The railroad crossing is marked with white crossing signs on both sides. The train was cleared to leave within a few hours.
The cause of the crash remains under investigation.
Our thoughts are with the families and loved ones of the two people who lost their lives during this heartbreaking time.
How Long Do Families Have to File a Wrongful Death Claim in Plattsmouth, NE?
In Plattsmouth and throughout Nebraska, families generally have two years from the date of death to pursue a wrongful death claim. If that deadline passes, they may lose the right to bring the case in court.
Because Nebraska law requires the deceased person’s personal representative to file the claim, families may need to open an estate before moving forward. Taking care of this step early can help prevent delays later.
When a train is involved, questions about fault may extend beyond the driver of the vehicle. Depending on what investigators find, the railroad company, train crew, crossing conditions, or warning systems may also need to be reviewed.
As the investigation continues, families should keep any information that may help show what happened. Crash reports, photographs, vehicle records, crossing records, train data, and available video may all become useful evidence.
In some cases, federal railroad safety rules and Nebraska negligence law may affect how responsibility is decided. Which rules apply will depend on the crossing, how the train was being operated, and the facts found during the investigation.
After responsibility is examined, families may also need to document the financial losses tied to the death. Funeral costs, lost income, household contributions, and other measurable losses may help show how the death has affected surviving family members.
If you are unsure about the filing deadline or who may be responsible, a
wrongful death lawyer can review the investigation, identify possible liable parties, and determine what evidence should be preserved. An attorney can also explain the steps required to bring the claim.
