How Long Do I Have to File a Car Accident Claim in Omaha, NE?
In Omaha and throughout Nebraska, you have four years from the date of a car crash to file a personal injury lawsuit in court.
In some situations, the deadline can be different. If an injured child is involved, the filing period may be extended. Claims against a city or county can also have shorter requirements, including a written claim that generally must be filed within one year.
When another driver causes a crash, that driver may be responsible for the losses that follow. An injured person may pursue compensation through the at-fault driver’s insurance coverage or by filing a claim against the driver.
Through that claim, you may be able to recover compensation for medical bills, lost income, and vehicle repairs or replacement. You may also seek payment for pain and suffering and future medical care related to your injuries.
To support your claim, keep police reports, photos, video footage, witness accounts, and medical records. These records can help show what happened, document your injuries, and support the losses you are seeking compensation for.
Even if another driver caused the crash, your share of fault can affect how much compensation you receive. Nebraska reduces your recovery based on your percentage of fault. If you are equally or more at fault than the parties you are seeking compensation from, you cannot recover damages.
As the claim moves forward, deadlines and filing requirements can be difficult to track. An
Omaha car accident lawyer can determine which deadline applies, communicate with insurers, and help make sure required paperwork is filed on time.
