What Compensation May Be Available After a Car Accident in Lincoln, NE?
People injured in a car accident in Nebraska may be eligible to seek compensation for medical expenses, lost wages, and other losses, depending on how the crash occurred and what insurance coverage is available. When multiple occupants are hurt in one vehicle, each person's injuries, expenses, and potential claims may need to be evaluated separately.
Nebraska follows a fault-based system for car accident claims. An injured person may pursue compensation from a driver whose negligence caused or contributed to the crash. However, Nebraska also applies modified comparative negligence rules. Generally, an injured person cannot recover damages if their negligence is equal to or greater than the negligence of the party they are suing. If their share of fault is lower, any recovery may be reduced proportionally.
For people with serious injuries, compensation may include emergency treatment, hospital bills, rehabilitation, future medical care, lost income, reduced earning capacity, and pain and suffering when legally recoverable. Keeping medical records, treatment plans, receipts, wage statements, and insurance correspondence can help document these losses. Passengers may also have claims depending on the circumstances and applicable insurance policies.
Nebraska generally has a four-year statute of limitations for personal injury lawsuits, although exceptions can apply. Claims involving government entities may have different procedural requirements and deadlines. It is helpful to review potential claims promptly so that evidence, including photographs, witness details, and the official crash report, can be preserved.
