Who May Be Liable for a Fatal Pedestrian Crash in Scottsbluff, NE?
When a pedestrian dies after being struck by a vehicle, eligible surviving family members may have legal options if a driver’s negligence contributed to the death. Whether a claim is possible depends on the evidence and the circumstances surrounding the crash.
To evaluate responsibility, investigators may examine whether the driver exercised reasonable care, watched for pedestrians, and followed applicable traffic laws. If the pedestrian was crossing within a crosswalk, the driver’s actions and the surrounding roadway conditions may be especially relevant. Witness statements, vehicle damage, photographs, roadway evidence, and the official crash report can help clarify how the collision occurred.
If the evidence indicates that another party’s wrongful conduct caused the death, certain surviving family members may be eligible to pursue a wrongful death claim under Nebraska law. Potential damages may include qualifying funeral expenses, loss of financial support, and other losses recognized by law. Eligibility and the amount of any recovery depend on the circumstances and applicable legal requirements.
However, the deceased person’s actions may also affect the outcome of a claim. Nebraska follows a modified comparative negligence system, which generally bars recovery if the deceased person’s negligence was equal to or greater than the defendant’s. If the deceased person’s share of fault was lower, damages may be reduced proportionately.
Families should also be mindful of the time limits for filing a claim. Nebraska generally has a four-year statute of limitations for wrongful death claims, although exceptions and special procedural rules may apply. Seeking legal guidance promptly can help clarify eligibility requirements and applicable deadlines.
