How Long Families Have to File a Wrongful Death Lawsuit in Lincoln, NE
In Nebraska, families generally have two years from the date of death to file a wrongful death lawsuit. Missing that deadline can permanently bar a claim, regardless of how strong the case may be. For families that are grieving and managing the immediate aftermath of a fatal crash, it can make a significant difference to understand this window early.
Ejection crashes are among the most deadly types of road accidents. Being thrown from a vehicle dramatically increases the risk of fatal head trauma, internal injuries, and blunt force damage to the spine. When a crash results from another driver's failure to obey a traffic control, surviving family members may have grounds to pursue a wrongful death claim against the at-fault party.
Wrongful death cases typically rely on several forms of evidence such as police reports, witness statements, physical measurements of the scene, and data pulled from vehicle event recorders. Surveillance footage from nearby businesses or traffic cameras can also play a critical role. A car accident lawyer can help identify and preserve this evidence early, before it is lost or overwritten, and work with reconstruction experts to establish how the crash unfolded and who bears responsibility.
At Harris & Associates, we have worked with Nebraska families navigating loss after serious crashes. We can explain who may be eligible to bring a claim, what damages may be available, and what steps to take before the filing window closes.
