Can a Passenger File a Claim After a Motorcycle Accident in Lincoln, NE?
Yes. In Nebraska, a passenger injured in a motorcycle accident generally has the right to seek compensation through a personal injury claim. Depending on the circumstances, a claim may be filed against the at-fault driver, the motorcyclist, or both. Nebraska follows a modified comparative fault rule, which means a person can still recover damages as long as they are found to be less than 50 percent at fault for the wreck.
Motorcycle accidents are a serious concern along high-traffic corridors in Lincoln. Nebraska Parkway runs through a busy residential and commercial stretch of the city, and nearby roads such as South 27th Street, Pine Lake Road, and O Street see consistent vehicle and motorcycle traffic throughout the evening hours. Intersections along these corridors carry elevated risk, particularly after dark when visibility is reduced.
People hurt in motorcycle crashes usually face some of the most serious injuries of any road accident. Possible injuries in motorcycle crashes include broken limbs, road rash, traumatic brain injuries, and damage to the spine.
Serious and minor injuries can result in extended hospital stays, ongoing rehabilitation, and significant time away from work. Medical expenses can escalate quickly, and the financial impact may be felt for months or years. That is why it is crucial to seek legal guidance promptly. A personal injury attorney can review the details of your situation and help clarify what options may be available to you.
