What Happens Legally After a Fatal Two-Vehicle Crash in Lincoln, NE?
When a fatal crash happens at a rural intersection, families in Lincoln usually look to Nebraska's wrongful death statute to understand their options. Nebraska law allows a personal representative of the deceased's estate to bring a wrongful death claim on behalf of surviving family members, and the statute of limitations for doing so is generally two years from the date of death.
Surviving family members tend to face significant financial strain, including funeral costs, lost future income, and loss of companionship, all of which can be difficult to calculate without a clear picture of the deceased's earning history and life circumstances.
At the same time, the survivors from the crash may be dealing with their own recovery, adding another layer of complexity if fault is contested between multiple parties.
Nebraska follows a modified comparative negligence rule, which means any party found more than 50% at fault cannot recover damages, so determining how responsibility is divided between the two drivers matters a great deal in a case like this.
A wrongful death lawyer can help a grieving family gather police reports, witness statements, and crash reconstruction evidence early, since these details can be harder to obtain the longer a case sits unresolved.
