We wish everyone injured a full and steady recovery.
How Is Fault Determined After a Head-On Crash in Sidney, NE?
Fault after a head-on crash in Sidney is determined by examining which driver crossed into the opposing lane and whether either driver’s actions contributed to the collision. Investigators also consider the circumstances surrounding the crash and where the vehicles collided.
When drivers give different accounts of what happened, police reports, photographs, available video footage, eyewitness statements, and roadway marks can help establish the sequence of events. This evidence may also help determine whether speeding, distraction, or another factor contributed to the crash.
While you receive medical treatment, health insurance or applicable medical payments coverage may help cover eligible expenses. However, compensation through a claim against the responsible driver may take longer, leaving you responsible for some bills in the meantime.
Beyond your medical expenses, you may be entitled to compensation for lost income, vehicle damage, and pain and suffering. If your injuries have lasting effects, your claim may also include future treatment costs and reduced earning capacity.
If you were partly responsible for the crash, you may still recover compensation in Nebraska as long as you were less than 50% at fault. Your compensation is reduced based on your share of responsibility. If you were 50% or more at fault, you generally cannot recover compensation.
Under Nebraska law, you generally have four years from the date of the crash to file a personal injury lawsuit, although some exceptions may apply. If you miss this deadline, you may lose your right to seek compensation through the courts.
When an insurance company disputes who caused the collision, a
car accident lawyer can review the available evidence and challenge unsupported fault claims. An attorney can also handle communications with the insurer, giving you more time to focus on your recovery.
