How Long Do Families Have to File a Wrongful Death Claim in Alliance, NE?
Families in Alliance and throughout Nebraska generally have two years from the date of death to file a wrongful death lawsuit.
Under Nebraska law, the deceased person’s personal representative must file the lawsuit on behalf of eligible surviving family members. If no representative has been appointed, the family may need to request a court appointment before moving forward.
Depending on the family’s losses, a wrongful death claim may cover funeral expenses, lost financial support, lost services, and the loss of companionship. The compensation available depends on the support the deceased provided and how the death has affected surviving family members.
To support the claim, families may need funeral bills, financial records, and documents showing their loved one’s contributions to the household. These records can help establish the financial losses connected to the death.
If the two-year deadline passes, the court may dismiss the lawsuit, leaving the family unable to recover compensation through that claim. Starting early allows more time to gather records, appoint a personal representative, and prepare the necessary paperwork.
Because wrongful death claims involve specific legal requirements, a
wrongful death lawyer can help your family understand the filing process and meet important deadlines. An attorney can also handle insurance communications and explain what compensation your family may be entitled to pursue.
At Harris & Associates, we help families across Nebraska understand their legal options after losing a loved one in a fatal crash. We listen to your concerns, answer your questions, and guide you through the claims process based on your family’s circumstances.
