Who Can File a Wrongful Death Claim in Omaha, NE?
In Omaha and throughout Nebraska, only the personal representative of the person’s estate can file a wrongful death claim. The representative brings the claim for the surviving spouse and next of kin.
When a will names someone to handle the estate, that person may ask the county court to appoint them as the personal representative. If there is no will, the court can appoint someone to serve in that role.
After a claim is resolved, the money may be divided among eligible family members based on the financial loss each person experienced. The court must also approve a wrongful death settlement before the personal representative can accept it.
For a family, recoverable losses may include lost financial support and the value of companionship, comfort, and society. Nebraska does not allow compensation simply for grief, but the loss of a close family relationship may be considered when damages are decided.
A survival claim is different from a wrongful death claim. It may cover losses the person experienced before death, including medical costs, lost earnings, and conscious pain and suffering. Money recovered through a survival claim belongs to the estate.
If the person who died shared responsibility for the crash, that can affect the claim. Nebraska reduces damages based on that person’s share of fault and may bar recovery if their fault is equal to or greater than the combined fault of the people being sued.
Even while your family waits for the investigation to finish or speaks with an insurance company, the legal deadline continues to run. Nebraska generally gives the personal representative two years from the date of death to file a wrongful death lawsuit.
Before a lawsuit can move forward, someone must be appointed as the personal representative. An
Omaha wrongful death lawyer can help your family complete that process and deal with the court paperwork required before filing.
