Who Can File a Wrongful Death Claim in South Sioux City, NE?
In South Sioux City and throughout Nebraska, a wrongful death claim must be filed by the deceased person’s personal representative. The claim is brought for the benefit of the surviving spouse and next of kin who have experienced losses because of the death.
When a loved one dies unexpectedly, surviving family members may be able to seek compensation for losses tied to the death. These can include lost financial support and the loss of companionship, comfort, and society. Medical and funeral expenses may also be recoverable in some cases.
When questions arise about how a fatal crash occurred, evidence can help establish what happened. Police reports, photographs, video footage, vehicle damage, and other records may provide information about the events leading to the collision.
Insurance coverage can also affect the claims process. Reviewing the available policies and coverage limits can help determine what insurance may be available for losses connected to the death.
Under Nebraska law, a wrongful death action generally must be filed within two years of the person’s death. Failing to file within that period can prevent the claim from moving forward.
If a family is unsure how to proceed, a
wrongful death lawyer can review the circumstances, communicate with insurers, and explain the steps involved in pursuing a claim.
