Who Can File a Wrongful Death Claim in Kearney, NE?
In Kearney and throughout Nebraska, a wrongful death claim is filed by the deceased person’s personal representative. That representative brings the case for the benefit of the surviving spouse or next of kin rather than family members filing individual wrongful death actions.
If no personal representative has been appointed, the estate may need to complete that step before a claim can move forward. The person selected to serve will depend on the circumstances surrounding the estate.
When several relatives may benefit from a wrongful death case, they are generally represented through the same action. This creates one legal process for addressing the family’s losses instead of separate lawsuits arising from the same death.
Because wrongful death proceeds are intended for qualifying family members, the amount each person receives may depend on the loss that person experienced. A court may become involved if questions arise over how the recovery should be divided.
Under Nebraska law, wrongful death actions generally must be filed within two years of the person’s death. Families may therefore benefit from identifying the proper representative before too much of that filing period has passed.
Before a case is filed, a
wrongful death lawyer can confirm the proper representative, examine the available facts, and prepare the claim in the required party’s name. This can help avoid filing under someone who lacks legal authority.
