Who Can Be Held Liable for a Multi-Vehicle Accident in Omaha, NE?
After a multi-vehicle accident in Omaha, fault is determined by looking at each driver’s actions and how they contributed to the crash. Depending on what happened, one driver may be found responsible for the crash, or responsibility may be divided among multiple drivers.
Because Nebraska is an at-fault state, drivers who cause accidents may be responsible for the resulting losses. If more than one driver contributed to the crash, their insurance companies may need to determine each driver’s share of fault.
To support your claim, collect the police report, photographs of the vehicles, and witness contact information. Dashcam footage and nearby security cameras may also help show how the collisions happened and which driver was responsible.
If you are partly responsible for the crash, Nebraska’s comparative negligence law may affect your claim. You can generally recover damages if you are less than 50% at fault, but your share of responsibility reduces the amount.
Depending on your injuries, you may be able to recover medical expenses, lost income, and pain and suffering. If you need ongoing treatment, your claim may also include future medical bills and rehabilitation costs.
Under Nebraska law, you generally have four years from the crash date to file a personal injury lawsuit. Missing this deadline may prevent you from seeking damages in court, although some claims have different deadlines.
When multiple drivers or insurance companies are involved, an
Omaha personal injury lawyer can review the evidence and help determine who may be responsible. An attorney can also handle insurance negotiations and pursue your claim.
