What Legal Options Do Families Have After a Pedestrian Death in Omaha, NE?
When a pedestrian is killed by a vehicle in Omaha, surviving family members may be able to pursue a wrongful death claim under Nebraska law, and that process can move forward independently of any ongoing investigation into the circumstances of the crash.
In Nebraska, eligible surviving family members, including a spouse, children, and parents, may bring a wrongful death claim when a loved one is killed due to another party's negligence. Establishing exactly how and why a pedestrian came to be in a lane of traffic is often central to determining liability, particularly in cases where the full circumstances leading up to the crash are not immediately clear.
One important consideration in cases like this is Nebraska's modified comparative fault system, which allows compensation to be reduced or potentially barred if the deceased is found to bear significant responsibility for the events leading to the crash.
If an investigation determines that a pedestrian entered the roadway under circumstances unrelated to any fault of the driver, this can affect how liability is ultimately assessed. However, if the driver failed to maintain a proper lookout, was distracted, or otherwise contributed to the collision, the family may still have a strong basis for pursuing a wrongful death claim depending on the full findings of the investigation.
A wrongful death claim in Nebraska may allow surviving family members to recover significant and broad financial losses. Depending on the circumstances found by the investigation, damages may include the economic value of the deceased’s future earning capacity, funeral and burial expenses, and the loss of companionship, guidance, and support over time.
A wrongful death lawyer can assist a family in tracking the developing investigation, collecting evidence about how the incident occurred, and making certain that any resolution reached accurately reflects the total and lasting impact of their loss.
