How Does a Car Accident Claim Work in Omaha, NE?
An Omaha car accident claim usually starts by reporting the collision to an insurance company and opening a claim. From there, the insurer reviews what happened, determines coverage, and decides whether payment is owed.
After the claim is opened, an insurance adjuster may ask each driver for an account of what happened. The adjuster may inspect the vehicles, review the available insurance coverage, and determine which issues need to be resolved before making a decision.
Depending on how the accident affected you, compensation may include medical expenses, lost income, vehicle damage, and pain and suffering. The amount you may recover depends on the losses connected to your injuries and the circumstances of your claim.
To support your claim, keep medical records, bills, photographs, repair estimates, pay records, and messages from the insurance company. These materials can document your losses and give the insurer information to consider when evaluating what you are seeking.
Because Nebraska follows modified comparative negligence, fault can also affect your recovery. Your compensation may be reduced according to your percentage of fault, and you cannot recover if your fault equals or exceeds the combined fault of the people from whom you seek payment.
Once the insurer completes its review, it may make a settlement offer, dispute part of the claim, or refuse payment.
If the insurer disputes responsibility or does not fairly account for your losses, an
Omaha car accident lawyer can review its decision and negotiate on your behalf. An attorney can also determine whether to continue settlement discussions or take your case to court.
